    SOCIAL HOST LAW  

    §         Social Host Law states that any person 19 and over who is in control of the residence (parent, grandparent, older sibling…) and knew or should have known (this means if the police have been to the residence before, parents should have known drinking might occur) of underage drinking occurring on the property will be arrested for violating the social host law. 

    §         Even though the Social Host law violation is only a misdemeanor—it is also a "Scarlet Letter" in the community.

    §         It is the prerogative of the police officer to add a charge of endangering the welfare of a minor—which is a worse offense.

    §         EXCEPTIONS TO SOCIAL HOST LAW- Parent can provide limited alcohol to their own child in their own home and if other parents are also in that home, they may give permission for their own child to also consume.  Visiting parents must be present at the time of consented consumption by their own child. 

    §         Insurance Companies in Nassau County have been using the Social Host Law to not pay a claim for a lawsuit if someone is hurt or property is damaged during a house party where the parent was arrested for Social Hosting.

    §         Parents can limit their liability by locking up the liquor cabinet.

    §         Drinking house parties expose underage kids to much more than drinking—sexual assault, drug sales, etc....

    §         House Party with no parent home—if police are called and no parent is present and underaged kids are obviously drunk, the kids will be taken to the Nassau University Medical Center

    §         If parent comes home and a house party is going on— DO NOT WASTE ANY TIME IN KICKING ALL STUDENTS OUT.

    §         You are not legally required to take keys, but morally you should.

    §         Police in Nassau County are very proactive with the Social Host Law

    §         College Apartments in Nassau County—What if your 19 year old college student is the name on the lease for an apartment near one of our local colleges?  They can be arrested as the Host!

    §         IN 2011, ONCE A PARENT IS ARRESTED UNDER THE SOCIAL HOST LAW, IT IS FOREVER ON-LINE—PRESS RELEASES ARE CONSTANTLY GIVEN OUT FOR SOCIAL HOST ARRESTS AS WELL AS DWI ARRESTS
